Establishment of the Commission

The National Hajj Commission Act outlines the establishment, composition, functions, and governance of the Commission, ensuring efficient and transparent management of Hajj operations in The Gambia. Below is an overview of its key provisions:

  • Amir-ul-Hajj: The Chairman of the National Hajj Commission.
  • Commission: The National Hajj Commission, established under Section 3 of the Act.
  • President: Refers to the Head of State.
  • Hajj: The annual pilgrimage to the Kingdom of Saudi Arabia.

1. Establishment of the Commission

The Act establishes the National Hajj Commission, comprising:

  • Amir-ul-Hajj: Appointed by the President, the Amir-ul-Hajj must be a Gambian holding at least a degree in Shariah from a recognized institution, with expertise in Hajj operations.
  • Commission Members: Up to nine members appointed by the President, each possessing at least a Secondary School Certificate and recognized for good standing in society.
  • Secretariat: The Commission is supported by a Secretariat staffed by personnel appointed by the Personnel Management Office in consultation with the Amir-ul-Hajj.

2. Term of Office

  • Commission members serve a term of three years and are eligible for reappointment.
  • Members may resign by submitting written notice to the Office of the President.
  • Allowances for the Amir-ul-Hajj and other members are determined by the President.

3. Functions of the Commission

The Commission is entrusted with several critical responsibilities, including:

  • Advising the President on all policy matters relating to Hajj.
  • Formulating and issuing guidelines to establish minimum standards for operators providing Hajj services.
  • Monitoring operator compliance with the Act’s guidelines.
  • Ensuring the welfare and protection of pilgrims, including safeguarding them from unfair business practices.
  • Submitting a comprehensive report of Hajj operations to the President within three months of completing the annual pilgrimage.

4. The Secretariat

The Secretariat, known as the Office of the Gambia Pilgrims Affairs, supports the Commission’s operations. Key provisions include:

  • Amir-ul-Hajj: Acts as the executive officer, responsible for implementing the Commission’s policies and overseeing compliance with the law.
  • Permanent Secretary:
    • Works under the supervision of the Amir-ul-Hajj.
    • Maintains books, records, and correspondence of the Commission.
    • Prepares the Commission’s agenda in consultation with the Amir-ul-Hajj and records meeting minutes.
    • Performs other functions as assigned by the Commission or the Amir-ul-Hajj.
